Cabubble Terms of Use – Business Account (17 February 2020)

The CABUBBLE website (the "Site", "cabubble.co.uk") is operated and made available to you by Cabubble Limited ("Our", "Cabubble", "Us", "We"). The following terms ("Terms of Use", "Terms") govern your ("You", "Your") access to and use of Our Site. Please review these Terms of Use carefully. By accessing and/or using the Site, You agree to be bound by these Terms of Use.

We reserve the right to change, modify, add, or delete portions of these Terms of Use at any time without prior notice. The date at the top of this page will indicate when the Terms were last revised. Your continued access and use of the Site after any such changes constitutes Your binding acceptance of the new Terms of Use. If You do not agree to abide by these or any future Terms of Use, do not use or access (or continue to use or access) the Site. It is Your responsibility to check the Site to determine if there have been changes to these Terms of Use and to review such changes.

Unless otherwise stated, all of the contents of the Site are copyright of Cabubble Limited. No part or parts of the Site may be copied or incorporated into any other website, database, publication or other work in any form whatsoever without Our express written permission.

General

By accepting these Terms You also agree to the Cabubble Privacy Policy.

Our Site

Our Site is designed to offer the service of booking passenger surface transport online ("Services") from Hackney Carriage (Taxi) and Private Hire Operators ("Providers"). We do not supply or provide the physical transport and as such, in using Our Services You implicitly agree to the terms and conditions of Your chosen Provider who is solely responsible for Your transport.

Eligibility and Registration

You must be 18 years or older to use Our Service. By using Our Site, You undertake that You are 18 or older and that You have the capacity to understand, agree to and comply with these Terms of Use. You accept Our Terms on behalf of all passengers traveling as booked via our Service ("Passengers"). You should provide true, accurate and complete registration information to become a member of the Site ("Member") and should maintain this information on the account to keep it accurate, current and complete. During registration Members must select a username and password. Members will be responsible for all use of the Site under their username and for keeping their password secure. If a Member suspects that their account has been used without their consent, it is the Member's responsibility to report this to Us immediately. We may refuse to grant You (or may suspend at any time) a username that impersonates or may be mistakenly identified as someone else, is or may be protected by trademark or proprietary rights law, or is vulgar, offensive or in any way inappropriate, as determined by Us at Our sole discretion.

Booking

To place a booking request (the "Request", "Requests") You must be a Member of Our Site.

Your chosen Provider, via Our Site, is entitled to refuse any Request. We do not guarantee that a Provider will accept any Request. If Your Request is accepted by the Provider, We will provide confirmation of acceptance on Our Site and via e-mail to Your registered e-mail address (the "Confirmation"). The Confirmation will also be available to download as a PDF (Portable Document Format) file from Our Site. Once You have received the Confirmation, You have reserved transport for Your Passengers from Your chosen Provider and in turn You are bound by the Provider's terms and conditions of business. It is Your responsibility to understand the Provider's terms and conditions of business.

The Passenger must present the Confirmation, in printed or electronic form, to the driver from the Provider at the start of the journey.

Fares and Payment

Fares quoted are per vehicle. The fare payable as stated in the Confirmation must be paid to the driver from the Provider in accordance with the Provider's terms and conditions, or by credit/debit card to the Provider in advance of travel if this is specified at the time of booking. We do not accept or handle any payments to the Provider on Your behalf.

Messaging

You must not use any messaging facility available within Cabubble to send payment card numbers.

Your Responsibilities

It is Your responsibility when making a booking to ensure the chosen pick-up time is sufficient to reach the chosen destination on time. We offer no advice regarding the amount of time required to travel to any given destination and do not accept liability for the consequences of late arrival at the destination. It is Your responsibility to inform the Provider as soon as possible if Passengers are unable to be collected at the arranged place and time for whatever reason.

We will not act on Your behalf to resolve any queries or disputes You have with Your chosen Provider.

You undertake that all booking details submitted are accurate and genuine and payment card details submitted are authorised for Your use.

Booking Amendments and Cancellation

We supply Provider contact telephone numbers and an online messaging facility for each confirmed booking (the "Booking"). If Your Booking requires amendment You must contact the Provider yourself. We will not make or arrange amendments for You. To cancel a Booking You must use Our Site or contact the Provider and quote the unique booking reference provided in the Confirmation. Bookings paid in advance of travel to Your chosen Provider by credit/debit card are subject to Your Provider's Cancellation Policy.

Feedback Submission

Submission of feedback through Our Site ("Feedback") will be passed to Providers. The Feedback will be used by Providers at their sole discretion, and by Us at Our sole discretion.

Endorsement and Suitability of Providers

A Provider being shown on Our Site does not imply any endorsement of that Provider by Us. Providers registered with Us must prove possession of a valid Private Hire Operator Licence in England, Wales or Northern Ireland or Booking Office Licence in Scotland ("Licence"). Hackney Carriage (Taxi) Operators registered with Us must prove possession of: (1) valid insurance documentation; or (2) a local authority affidavit confirming eligibility to operate Hackney Carriages (the "Documentation"). We are not responsible for assessing Providers' compliance with the terms under which their Licence or Documentation is issued.

Access and Use of Quotes

Our Site must only be accessed using a conventional web browser or authorised Cabubble application on a personal computer or mobile device, and web pages accessed via the Site are only for use by Members or prospective Members to find and book surface transport. They must not be used for any other purpose.

Liability

We do not provide any transport services and as such are not responsible or liable for the transport You may book with any Provider. Any booking Requests are made direct with a Provider entirely at Your discretion. In no event shall We or any of Our agents or suppliers be liable for any consequential, special, incidental or indirect harm or damages of any kind arising from the delivery, performance, use of or inability to use Our Site and Services, even if We have been advised of the possibility of such damages.

Affiliate Sites

Where a Booking is made via an affiliate website ("Affiliate"), the Affiliate is not responsible for the Booking and is not acting as a travel agent in relation to the Booking. The Booking is made direct with the Member's chosen Provider.

Violation

If a Member violates these Terms, Cabubble and its Providers reserve the right to suspend the Member's account and access to Our Services without notice. We also reserve the right to close and delete any suspended account without notice.

Notices

All notices shall be given to Us via email at the specified address for Services accepted on Our Site or to You at either the e-mail or any postal address stored on Your account.

These Terms shall be governed by the laws of England.
